Terms and Conditions

These Terms and Conditions govern the submission of screenplays, treatments, pitch decks, scripts, and all other development materials (“Submission”) submitted by writers or producers (“Submitter“) to CHOOSEDAY Studios Pty Ltd (“Studio”) for consideration in our film and television slate.

Integrity and Confidentiality of Submissions

The Studio is committed to maintaining the integrity, privacy, and confidentiality of all Submissions in accordance with our privacy policy. We respect the creative efforts of the Submitter and will not disclose the Submission to any external third party without formal written consent from the Submitter.

Similar Content Disclaimer

The Studio acknowledges that unintentional similarities may exist between Submissions and the Studio’s current or future projects. This does not imply plagiarism or intellectual property theft. The Studio does not guarantee the absence of similar projects in development, preproduction, production, or post-production.

No Obligation to Use or Sell

Submitting to the Studio does not create an obligation on either the Studio’s or the Submitter’s part to use, produce, compensate for, or sell the submitted material, unless a separate agreement is entered into.

Representation and Warranties

The Submitter represents and warrants that they have full legal right to the Submission and that it does not infringe upon the rights of any third party.

Rights and Ownership

The Submitter retains all rights and ownership of the Submission and grants the Studio a non-exclusive, royalty-free license to review, analyse, assess, and consider the material for potential acquisition, development, production, or co-production.

Indemnification

The Submitter agrees to indemnify the Studio against any claims arising from the Submitter’s breach of these terms or any representation or warranty.

Dispute Resolution

Any disputes arising under these terms will be resolved through mediation or arbitration in Queensland, Australia, before resorting to litigation.

Limitation of Liability

The Studio’s liability in connection with the Submission is limited to the fullest extent permitted by law.

Submission Procedure Details

Submissions must be made in accordance with the Studio’s specified procedures and formats.

Australian Law Compliance

These Terms and Conditions are governed in accordance with the laws of Queensland, Australia. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the Australian State and Federal courts.

Acknowledgement

By submitting a Submission to the Studio, the Submitter acknowledges and agrees to these Terms and Conditions.
